The New York Fed had previously stated that the terms were the "same", which is not technically accurate. The rate contemplated by the private sector consortium was Libor plus 6.5% whereas the Fed’s rate was Libor plus 8.5%. The 200 bp difference is attributable to deteriorating market conditions between the time the private consortium met and the time of the Fed’s loan.
